Indiana Needs the Second Amendment Preservation Act!

I know that it’s almost Christmas and most Hoosiers are hurrying to finish their work week a little early and getting ready to spend time with their families.

But as you do that, don’t forget that the 2023 legislative session is almost here, and it’s never been more important that Indiana lawmakers pass the Second Amendment Preservation Act (SAPA)!

Joe Biden is furious that he lost control of the House in November because it means that the old days of Nancy Pelosi just ramming his gun control through that chamber are over.

That’s why Biden is already preparing to unleash even more Executive Orders against the Second Amendment next year — it’s the only tool that he’s got left.

But don’t forget: Joe Biden and his team know that the only way that their Executive Orders can be used against gun owners is if Indiana cops agree to enforce them here.

And that’s why we need SAPA so badly.

SAPA legislation reminds the White House that Indiana is a sovereign state, that the Indiana State Constitution protects gun rights here, and that Indiana taxpayers hire Indiana cops to enforce laws passed by the Indiana legislature.

In other words, Indiana isn’t his vassal state and Indiana cops are not mere appendages of the Department of Justice.

Specifically, SAPA law tells Indiana cops to ignore federal gun control laws and exclusively enforce Indiana laws when it comes to firearms, ammunition, and accessories.

And the moment Indiana cops stop enforcing Biden’s war against gun owners, his attacks will collapse under their own weight!

Could Biden swarm Indiana with feds to enforce Executive Orders and the rest of the federal gun control agenda? Yes. But it won’t happen.

First, Biden can’t afford the political optics of suburban loads of feds rolling around Indiana knocking down doors enforcing tyrannical orders that ban pistol braces.

Second, Biden doesn’t have the manpower to pull that off in force. Can they raid a home here and there? Of course. But can the feds take the place of every Indiana trooper, deputy, and city cop? Impossible.

You see, SAPA law doesn’t challenge federal authority or the Supremacy Clause. SAPA simply refocuses Indiana cops on enforcing Indiana gun laws — denying Biden the free use of our cops!

That’s why the Supreme Court has upheld this concept every time it’s come before the bench.

And that’s why Missouri’s SAPA law (which IFC’s SAPA legislation is based on) has survived three court challenges without being overturned!

But we have to be realistic.

The fact of the matter is that a growing number of police chiefs across the state will NOT want to abide by SAPA law — as their departments receive payments from the DOJ for helping to enforce federal gun control edicts!  

That’s why SAPA legislation must have legislative ‘teeth.’

Ours does. If a municipality violates SAPA law here in Indiana and orders their law enforcement agencies to enforce federal gun control laws, Hoosiers could take that city and that law enforcement agency into civil court for damages!

And far from being anti-cop, SAPA protects the legions of pro-gun cops here in the state that DO NOT want to be forced to carry out Joe Biden’s gun control agenda.
